2. User Accounts

2.1 Account Creation

• You must provide accurate and complete information
• You must be at least 18 years old to use our service
• You are responsible for maintaining account security
• You must not share your account credentials

2.2 Reseller Accounts

• Require minimum 10 keys purchase to qualify
• Gain access to API, IP whitelisting, and rate limit controls
• Must comply with API Terms (Section 7)
• Business use only - not for personal account upgrades

3. Lifetime Guarantee

3.1 Replacement Process

• Use the "Renew" page to request a replacement
• Provide your original key and Spotify credentials
• Automated processing within minutes
• No limit on number of replacements

3.2 Guarantee Terms

• Valid as long as Upgrader.cc operates
• No time limit or expiration date
• Applies to all keys purchased, past and future
• Transferable if you sell your account (contact support)

4. Payment Terms

• Prices are subject to change but honored at time of purchase
• Volume discounts apply for reseller packages

4.2 Payment Methods

4.3 Refund Policy

• Keys work as described: Unlimited free replacements (not refunds)
• Technical issues: Full refund within 48 hours if unresolved
• Buyer's remorse: No refunds (digital goods policy)

5. User Responsibilities

By using our service, you agree to:

• Valid Spotify Account: Have an existing Spotify Free account
• Accurate Credentials: Provide correct username and password
• Email Access: Use valid email for key delivery and support
• Country Selection: Choose correct country (affects invite availability)
• Reasonable Use: Not abuse the service with excessive requests
• Spotify TOS: Understand Spotify's terms (we're not responsible for their policies)

Violation of these terms may result in immediate account termination without refund.

7. API Terms (Resellers)

7.1 API Access

• Granted only to reseller accounts (10+ keys)
• API keys must be kept secure (SHA-256 hashed)
• IP whitelisting required for production use
• Rate limits: 1000 requests/hour default (contact for increase)

7.2 Reseller Responsibilities

• Maintain your own customer support
• Comply with payment processor terms (Stripe/PayPal/etc)
• Not claim to be Upgrader.cc or Spotify
• Implement proper security (HTTPS, input validation)

7.3 API Restrictions

• No scraping or data harvesting
• No circumventing rate limits or security measures
• No sharing API keys with unauthorized parties
• Violation results in immediate API revocation

8. Intellectual Property

• Our Content: Website design, logos, code, and documentation are owned by Upgrader.cc
• Spotify Trademarks: "Spotify" and related marks are owned by Spotify AB (not us)
• No License: These Terms do not grant you any rights to our intellectual property
• DMCA: Report copyright violations to [email protected]

9. Termination

9.1 By You

You may delete your account anytime from Dashboard → Settings. Your keys remain valid with lifetime guarantee.

9.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent activity
• Abuse the service or API
• Violate applicable laws

Note: Lifetime guarantee applies even if account terminated (use guest checkout for renewals).

11.2 Arbitration

Most disputes will be resolved through binding arbitration rather than court proceedings, except for:

• Intellectual property claims
• Claims that qualify for small claims court (if you choose to file there)
• Injunctive or equitable relief

Arbitration will be conducted by a neutral arbitrator in accordance with applicable arbitration rules. Each party will bear their own costs, except as required by law. You waive the right to participate in class actions or class arbitrations.

11.3 Governing Law & Jurisdiction

These Terms are governed by international commercial law principles and the laws applicable to arbitration proceedings. All disputes will be resolved through binding international arbitration as described above, rather than through courts.
